Types of Conduct Constituting Insurance Bad Faith

When the Arizona courts to consider the actions of the insurer is the insurance bad faith, they look at the “reasonableness” of action of the insurer. Unfortunately, there is not a complete list of what is insurance bad faith, but following a few broad areas of conduct, Arizona courts have agreed to be reasonable and support for finding bad faith against insurers in Arizona:

* Failure to make prompt payment to compel the insured in the settlement, however, that the debt;

* Failure to pay claims without conducting a reasonable investigation based on all available information;

* Delay processing of a claim;

* Otherwise, to promptly provide a reasonable explanation of the basis in the insurance policy in relation to the facts or applicable law for denial of the claim or the offer of a compromise settlement.

* Otherwise, to advise the insured committed to provide certain forms;

* Based on the policies of the previously invalidated.

Some of these standards, and others, have been codified in ARS ยง 20-461, Arizona Unfair claims practices statute, which prohibits certain behavior by the insurer in the restructuring of claims.

When it comes to insurance companies, individuals and businesses should keep in mind that even if the insurer pays the ultimate claim, he may still be liable for bad faith. Only show bad faith refusal to pay the initial approval is essential because of the bad faith tort action. Many cases arise, for example, when an insurer denies the claim quickly, based on a misunderstanding of some information, which is a direct result of the inability of the insurer to conduct a reasonable and adequate investigation.
